The Company initially sought confidential treatment of the asset purchase agreement dated October
12, 2009 between the Schering Corporation and the Company on March 12, 2010. Since such date, we
have been engaged in ongoing dialog with the SEC regarding various aspects of our confidential
treatment request. We received our latest correspondence from the
SEC on October 1, 2010 and anticipate responding this week. We will keep you informed of our
progress in resolving the matter.
